Outfitma Creator Terms – Executive Summary

This Creator Terms document governs the relationship between you (the Creator) and Outfitma (“we”, “us” or “our”) when you use Outfitma’s platform to publish and — where the relevant functionality is enabled — monetize your styling content and services. It supplements the Terms of Service and other policies (Content License, Commerce Policy, Community Guidelines, Copyright Policy, Acceptable Use Policy), and together they form the entire agreement between you and Outfitma. The Outfitma legal entity has not yet been registered; the registered entity will be identified here upon incorporation.
Feature availability: During the current beta phases, Creator access is restricted (see Section 3), no payments are processed through Outfitma, and monetization features (paid Subscriptions, PPV, Digital Products, Styling Services) are not yet enabled. The monetization, payment, payout, and refund provisions below describe how Outfitma is intended to operate when those features become available; they do not create a right to monetize, to receive payouts, or to sell before the relevant feature is offered to you.
Key highlights:
Ownership and License: You retain 100% ownership of the content (photos, videos, text, outfits, guides, etc.) you create and upload (your User Content). You grant Outfitma a limited, non-exclusive, worldwide, royalty-free license to host, reproduce, display, and deliver your content only as needed to operate the platform (including caching and thumbnail generation). Outfitma will not use your content in advertising or marketing without your express consent.
Monetization (where enabled): When monetization features are enabled, you may monetize your content through Subscriptions (recurring payments for access) and, if and when the relevant functionality launches, Pay-Per-View (one-time payments for individual pieces of content), Digital Products (e.g. e-books, outfit guides, downloadable assets), and Styling Services (e.g. personal consultations, wardrobe reviews). Outfitma retains a 20% commission on all sales; you receive 80%. For example, if a customer pays $10 for a month’s subscription, you receive $8 and Outfitma keeps $2.
Payments & Payouts (where enabled): When paid features are enabled, customer payments will be processed by Outfitma or through third-party payment providers. Payouts to creators will be made periodically via a method, schedule, and minimum threshold published before payouts are enabled (these are business decisions that have not yet been made). You are responsible for reporting and paying any income taxes on your earnings, and providing necessary tax information when requested.
Content Standards & Compliance: You must follow Outfitma’s Community Guidelines and Acceptable Use Policy regarding content and conduct. Prohibited content includes illegal products (counterfeits, narcotics, etc.), explicit pornography, hate speech, harassment, defamatory or infringing material, and any content not allowed under our rules (including content against third-party platform rules if your offerings link externally). Importantly, AI-generated or AI-manipulated content of real people without consent is not allowed. You must also comply with all applicable laws (e.g. selling certain products, delivering services).
Refunds & Cancellations: Refunds to customers are generally handled per our Commerce Policy. In essence, subscription fees are non-refundable and provide access until the end of the paid period (no pro-rated refunds). Pay-per-view and digital purchases are final sale (no refunds except as required by law). If a customer refunds or disputes a payment, Outfitma may recover funds from you as described in the Commerce Policy.
Account Termination & Data Retention: If you delete or terminate your creator account (or Outfitma suspends/terminates it), no new subscriptions or sales will occur. However, customers who have already paid (e.g. ongoing subscriptions or completed purchases) will retain access to the content they paid for until the end of their paid period or access term. After that, your content will no longer be available to them. Outfitma may retain your content and data only as needed to fulfill these obligations, resolve disputes, prevent fraud, or comply with legal requirements, and only for a limited time.
Moderation & Takedowns: Outfitma reserves the right to remove or disable any of your content or suspend/terminate your account at our discretion (for violation of these terms, other policies, or any other reason) without liability. We will follow our Copyright Policy if anyone (including us) receives a valid notice of copyright infringement regarding your content.
Warranties, Indemnification & Liability: We provide the platform “as is” and do not guarantee any earnings or success; your income depends on your content and marketing. You warrant that you have all rights to the content you post and that it does not violate any laws. You agree to indemnify and hold Outfitma and its affiliates harmless from any claims arising from your content or violations of these terms. Outfitma’s total liability to you is limited as set forth in our Terms of Service.
Governing Law: These Creator Terms (and all related agreements) are governed by the laws of Germany (and applicable EU law) without regard to conflict of laws principles. Disputes are subject to the jurisdiction of the competent courts of Germany, unless mandatory law provides otherwise. The specific court venue will be fixed upon registration of the operating legal entity and is subject to legal review.
This document is a broad overview. Please read the full terms below. For detailed rules on content, payments, and other matters, refer also to the linked policies mentioned above.
Definitions
The following terms have these meanings when capitalized in these Creator Terms:
- “Creator.” You, a user who creates and publishes content or offers services on Outfitma (also referred to as Stylist, Seller, or Content Provider).
- “Customer.” A user of Outfitma who purchases access to a Creator’s offerings (e.g. a subscriber or one-time buyer).
- “Subscription.” A recurring payment plan that provides a Customer with periodic access (e.g. monthly) to a Creator’s content or services for the duration of the subscription period.
- “Paid Content.” Any content or service offered by a Creator to Customers for payment. This includes Subscriptions, Pay-Per-View content, Digital Products, and Styling Services.
- “Pay-Per-View (PPV).” A one-time purchase of a specific piece of content (for example, a single outfit photo or video) or service that grants the Customer access to that content indefinitely or for a limited time as described in the offering.
- “Digital Product.” A non-interactive downloadable or viewable item sold by a Creator (for example, outfit templates, e-books, guides, patterns, or video courses).
- “Styling Service.” A personal consultation or custom service provided by a Creator, typically delivered online (for example, wardrobe consultation, outfit design advice, or virtual personal shopping).
- **“Platform” or “Services.” The Outfitma platform and website, including all related features and functionalities that enable Creators to publish and — where enabled — sell content and Customers to access or purchase it. The terms “Platform” and “Services” include the Outfitma mobile app (if any) and websites (e.g.
https://outfitma.com). - “User Content.” Any content (including photos, text, videos, designs, and recordings) that a Creator submits, uploads or makes available through Outfitma.
- “Fees.” Any charges taken by Outfitma for use of the Services, including the commission, processing fees, subscription fees, feature fees, etc.
- “Commission.” The percentage of each payment that Outfitma keeps as a fee for providing the platform services (currently 20% of the gross price for any Paid Content).
- “Refund.” A return of funds to a Customer, in whole or part, under Outfitma’s policies for canceled subscriptions or disputed purchases.
- “Account.” Your user account on Outfitma, which may include a profile page, dashboard, and settings.
- “Applicable Laws.” All laws, regulations, and rules applicable to the use of Outfitma, including consumer protection, e-commerce, tax, privacy, intellectual property, and export laws of Germany, the EU, and any other relevant jurisdictions.
Unless otherwise defined here, other capitalized terms have the meanings given to them in the Terms of Service.
1. Scope of These Creator Terms
- These Creator Terms apply if you register as a Creator on Outfitma and use your account to publish Paid Content or offer Styling Services to Customers. They govern your relationship with Outfitma in your role as a Creator.
- When you create or use a Creator account, you agree to be bound by (a) the Terms of Service, (b) these Creator Terms, and (c) any other policies referenced herein (Content License, Commerce Policy, Community Guidelines, Copyright Policy, Acceptable Use Policy). If there is any conflict between these terms and other policies, the Terms of Service shall control unless explicitly stated otherwise.
- If you use Outfitma solely as a Customer (to subscribe, purchase or follow creators), the terms that apply to you are the Terms of Service and other Customer-related policies. These Creator Terms do not apply to such users.
2. Eligibility
- Age and Capacity: To become a Creator, you must be at least 18 years old and have the legal capacity to enter into binding contracts in your jurisdiction. If you are registering on behalf of an entity, you must have the authority to bind that entity.
- Lawful Use: You represent and warrant that your use of Outfitma, including selling content or services, is permitted by all Applicable Laws in your jurisdiction (e.g., business licenses, consumer protection rules). If your content or services are restricted or regulated (e.g. fashion with controlled substances, licensed designs, etc.), you are solely responsible for compliance.
3. Account Registration and Onboarding
- Beta access and the Stylist Waitlist: During the current beta phases, Creator onboarding is restricted. Prospective Creators may express interest through the Stylist Waitlist on the Outfitma landing page. Waitlist submission does not create an account and does not guarantee approval, access, Creator status, publication privileges, or monetization. If Outfitma approves your interest, your email address may be added to the Beta Whitelist, after which you can register through the normal authentication flow. See the Terms of Service, Section 3.
- Creating an Account: To become a Creator, you must register for an account on Outfitma and provide accurate, complete, and current information. Sign-in is passwordless: a one-time code sent to your email, a magic sign-in link, or Google Sign-In. You agree not to create multiple accounts under different identities or transfer your account without Outfitma’s permission.
- Verification: Outfitma may require additional information or verification (e.g. identification, tax information) before approving your Creator account or enabling certain features (such as payments). You agree to promptly provide any requested information.
- Account Duties: You are responsible for maintaining the security of your account — in particular your email mailbox and any sign-in codes or links, which function as your credentials — and for all actions taken under it. Notify Outfitma immediately of any unauthorized use of your account.
- Account Approval and Suspension: Outfitma may accept or reject any account application at its discretion. We may also suspend or terminate your account at any time if we suspect any violation of these terms or policies (see Section 10).
- Assisted Onboarding (Beta 0): During the current beta phase, Outfitma may invite prospective Creators directly (for example via a social-media direct message) and onboard them with hands-on assistance. In this flow, you provide your outfits and capsules to Outfitma through an off-platform channel — typically a shared Google Drive folder using Outfitma’s content template — and Outfitma prepares and publishes that content to your Creator profile on your behalf. Preparation may include automated and AI-assisted media processing via third-party AI providers (currently Google Gemini), for example extracting item thumbnails from your outfit and capsule photos. Content you provide this way is your User Content: the same license (Section 5 and the Content License Agreement) and the same warranties and responsibilities (Sections 4 and 11) apply as if you had uploaded it through the Platform yourself. Any processing of personal data in this flow is described in the Privacy Policy. Outfitma intends to replace this assisted flow with self-serve upload tooling during the beta.
Steps F–H describe the intended commercial flow once paid features and payouts are enabled; they are not active today. During Beta 0 assisted onboarding (Section 3.6), steps C–E may be carried out with Outfitma’s help: the Creator provides content via a shared Google Drive folder and Outfitma processes (including AI-assisted thumbnail extraction) and publishes it on the Creator’s behalf.
4. Creator Responsibilities
4.1 Compliance with Policies and Laws. As a Creator, you must at all times comply with Outfitma’s Community Guidelines and Acceptable Use Policy as well as all Applicable Laws. This includes, but is not limited to, laws regarding intellectual property, privacy, consumer protection, and advertising. Failure to comply may result in removal of content or suspension of your account.
4.2 Content Standards. Your content and services must be safe, legal, and appropriate for our global platform. You expressly agree not to upload or offer any content or service that:
- Violates any law or third-party right (including intellectual property rights) – e.g. copyrighted images without permission, counterfeit goods, proprietary designs, or trademarked logos unless you have a license.
- Contains pornography or explicit sexual content (subject to our Community Guidelines and applicable law).
- Promotes hate, violence, self-harm, or illegal activities.
- Is defamatory, harassing, threatening, or otherwise abusive.
- Misleads customers or includes phishing/scam content.
- Violate privacy or personal data of others (e.g. sharing private images or information without consent).
- Depicts AI-generated or AI-manipulated images of real individuals without their permission, or otherwise violates rights in images or AI content.
- Any other prohibited content listed in the Community Guidelines.
4.3 Accuracy of Information. You must accurately describe your offerings (subscriptions, PPV content, products, services). Do not falsely advertise or misrepresent what customers will receive.
4.4 Customer Interaction. If you offer services (e.g. consultations), you must deliver them at the agreed time and manner. Provide timely customer support and address any questions or issues from your customers professionally.
4.5 Updates and Changes. You are responsible for updating your content and offerings as needed (e.g. new images for monthly subscriptions). Outfitma is not obligated to ensure your offerings remain up-to-date.
5. Content Ownership and License
5.1 Creator’s Ownership. You retain all rights, title, and interest in and to your User Content. Outfitma does not claim any ownership of your content.
5.2 License to Outfitma. By uploading User Content, providing content to Outfitma for publication through an assisted-onboarding channel (see Section 3.6), or enabling an offering on the Platform, you grant Outfitma a worldwide, non-exclusive, royalty-free license to:
- Host, reproduce, display, and transmit your content on the Platform and to other users (Customers).
- Modify, translate, resize, or create adaptations of your content solely for technical purposes (for example, converting formats or generating thumbnails, including through AI-assisted processing as described in Section 3.6) and for optimizing display on various devices.
- Cache and store copies of your content as needed to efficiently provide and backup the Services.
- Use your content for search, recommendation, or analytics features within Outfitma.
This license is solely for operating and improving Outfitma’s services; it does not include the right to use your content in advertising or external marketing. Any external use (e.g. on social media or in ads) requires your prior permission (see Section 6.4 below).
5.3 Content License Duration. The license to Outfitma continues while you have an active Creator account or have content on the Platform. If you delete content or your account is terminated, Outfitma’s right to use that content ends, except as needed to provide paid access to existing Customers (as described in Sections 7 and 10) or as required by law.
5.4 Reservation of Rights. All rights not expressly granted herein are reserved to you. You also grant Outfitma the right to sublicense any of the above rights to third-party service providers (e.g. hosting or payment processors) solely to the extent needed to deliver our Services.
6. Monetization: Offerings, Fees, and Commission
Feature availability: This Section applies if and when the relevant monetization functionality is enabled for your account. No payments are currently processed through Outfitma.
6.1 Types of Offerings. Where the relevant functionality is available, Outfitma allows you to monetize through the following options:
- Subscriptions: Recurring membership plans (e.g. monthly or yearly) through which Customers get regular access to content (e.g. weekly outfit tips). You set the price and access terms.
- Pay-Per-View (PPV) Content: One-time purchases for specific pieces of content. For example, a customer might pay for an exclusive outfit photograph or style video. Once purchased, the customer can access it as defined in the offering.
- Digital Products: Downloadable or viewable items sold individually, such as pattern templates, e-books, or style guides. Customers pay once and receive the digital file.
- Styling Services: Personalized services delivered virtually (e.g. one-on-one consultation, wardrobe audit, custom outfit design). These may be offered as single sessions or packages. When a customer purchases a service, you agree to deliver that service within a reasonable timeframe.
- Other: If Outfitma introduces new monetization methods (merchandise integration, affiliate links, etc.), they will be governed by this agreement or supplemental terms if provided.
6.2 Pricing and Commission. You set the prices for your subscriptions, PPV items, products, and services. Outfitma will display the full price to Customers. For each sale, Outfitma retains a 20% commission on the gross amount (before taxes). The remaining 80% (less any payment processing fees as per Section 7) is your net revenue.

6.3 Taxes. Applicable sales or VAT taxes are added at checkout and handled by Outfitma’s payment processor. Creators are responsible for reporting and remitting any taxes on income they receive (such as income tax) in their jurisdiction. Outfitma may require tax information from you (e.g. VAT ID or W-8/W-9 forms) to comply with tax laws.
6.4 Affiliate Links and Advertising. You may include links to third-party shops or affiliate programs within your content, provided such links comply with Outfitma’s policies and laws. Outfitma itself may display affiliate or promotional content, but Outfitma’s use of your content in external advertising requires separate consent.
7. Payments and Payouts
Feature availability: This Section applies if and when paid features and payouts are enabled. No payments are currently processed through Outfitma and no payouts are currently made.
7.1 Payment Processing. When paid features are enabled, payments from Customers (for subscriptions and, where available, other offerings) are processed by Outfitma or third-party payment providers. Payment methods may include credit cards, digital wallets, or other services. Outfitma is not responsible for failures in the payment system beyond refunding customers per policy.
7.2 Payout Schedule. Outfitma transfers your earnings (80% share) to you on a regular basis (for example, monthly). The exact schedule and cutoff dates will be communicated to you (details may be in your Creator Dashboard). Payouts are made via your selected payout method (e.g. bank transfer or payment service).
7.3 Minimum Payout Threshold. A minimum balance for payout may apply (to cover transaction fees). If your balance does not meet the threshold, it may roll over until the next period (specific threshold and currency will be set by Outfitma and communicated to you).
7.4 Payment Deductions and Fees. In addition to the 20% commission, Outfitma may deduct any applicable transaction fees (e.g. card processing fees) before payout. Also, Outfitma is required to withhold taxes from payouts if legally mandated (for example, if you fail to provide tax info or under certain jurisdictional rules). Any such withholding will be reported to you.
7.5 Payment Account Information. When payouts are enabled, you must provide accurate payment information for a payout method Outfitma supports (the supported methods will be published before payouts are enabled) and keep it updated. If a payout fails (e.g. incorrect account), Outfitma will attempt to notify you. You are responsible for any associated fees (e.g. wire fees).
8. Refunds and Subscription Cancellations
8.1 General Refund Policy. Outfitma’s Commerce Policy contains our detailed refund terms. In general:
- Subscriptions: When a customer cancels or requests a refund for a subscription, they keep access until the end of the current paid period; we do not prorate refunds mid-term. Future renewals stop.
- PPV / Digital Products: Sales are final once delivered. No automatic refunds unless required by law (e.g. within a cooling-off period, if applicable).
- Styling Services: If a customer cancels a service booking well before the scheduled session, a partial refund may be possible per Commerce Policy. If a Creator cancels a confirmed booking, the customer must receive a full refund.
- Outfitma reserves the right to offer or require refunds or credits for any reason (e.g. service outage, fraudulent charges) in accordance with our policies and for legal compliance.
8.2 Effect on Creator Earnings. If a sale is refunded, the refunded amount (plus any fees) will be deducted from your account (if already paid out) or your future earnings. Outfitma may also charge a fixed refund processing fee as per the Commerce Policy.
8.3 Auto-Renewal on Cancellation or Account End. If you delete or terminate your Creator account, Outfitma will disable auto-renewal for all your active subscriptions. Subscribers will not be charged again, and their access will simply expire at the end of the last paid period.
9. Account Deletion and Data Retention
9.1 Creator-Initiated Deletion. You may request deletion of your Creator account at any time by emailing team@outfitma.com from the email address associated with your account. Deletion is currently handled as a manual support request (there is no self-service deletion control yet); Outfitma fulfills verified requests without undue delay and within the timeframe required by applicable law. Deletion is permanent and cannot be undone. Before your account is deleted, ensure you have backed up any content or data you wish to keep.
9.2 Company-Initiated Termination. Outfitma may terminate or suspend your account for any reason, including breach of these Creator Terms, fraudulent activity, or policy violations. If terminated, you will receive notice, and your content may be removed or disabled.
9.3 Post-Deletion Access for Customers. After your account ends, any Customer who has paid for access will retain it until the end of their paid term, but will not receive new content. For example, if a subscriber’s monthly payment was paid through the end of July, they keep access until July 31. No renewal or future access beyond that date.
9.4 Retention of Creator Data. After account deletion or termination, Outfitma will retain your content and records only as long as necessary to:
- Provide access to paid Customers (as described above).
- Fulfill any legal or regulatory obligations (e.g. tax records, anti-fraud).
- Resolve any disputes or enforce agreements. We will then delete or anonymize your personal data and content. The exact retention period is unspecified but will follow applicable law.
10. Moderation, Takedown, and Intellectual Property
10.1 Outfitma’s Right to Remove Content. Outfitma may review your User Content and offerings. We reserve the right (but are not obligated) to remove or disable any content or account that we believe violates these terms or our policies, or for any reason at our discretion. We may do so without notice or liability.
10.2 Copyright Infringement. If a third party claims your content infringes their IP, Outfitma will respond per our Copyright Policy. You are responsible for all content you post. Outfitma expects you to comply with copyright laws. Repeat infringers may have their accounts terminated.
10.3 Copyright Complaints and EU Regulations. If Outfitma receives a valid copyright complaint concerning your content (including under applicable EU rules), Outfitma will remove or disable the content and notify you. You may submit a counter-notice if you believe your content was removed in error. For EU, you have rights under the Digital Services Act (DSA). Details are in the Copyright Policy.
11. Warranties and Disclaimers
- No Earnings Guarantee. You acknowledge that Outfitma provides a platform, not a guarantee of customers or income. Outfitma does not promise any specific level of sales or success. Your earnings depend on your content quality, marketing efforts, and other factors.
- No Professional Advice. If you are providing advice or services (e.g. personal styling), ensure you are qualified. Outfitma does not vet your expertise. Customers rely on your professional judgment.
- Platform “As Is.” Outfitma’s services are provided “as is” without any warranties. We disclaim all warranties to the fullest extent permitted by law (see Terms of Service). You use the platform at your own risk.
12. Indemnification
You agree to indemnify, defend, and hold Outfitma, its officers, directors, employees, agents, and affiliates harmless from any losses, claims, damages, or liabilities (including legal fees) arising from:
- Your User Content or offerings (e.g. claims of defamation, IP infringement, or other illegal content).
- Your breach of these Creator Terms or applicable law.
- Any claims by customers related to your services (e.g. dissatisfaction, injury, fraud claims).
This obligation survives account termination.
13. Limitation of Liability
To the extent permitted by law, Outfitma’s total liability to you for any claim arising under these Creator Terms or related to your use of the Services is limited to the total amount of commissions paid by you to Outfitma in the 12 months preceding the claim. Outfitma is not liable for indirect, special, or consequential damages (e.g. lost profits, loss of business opportunity).
14. Term and Termination
14.1 Term. These Creator Terms are effective as of the date you start using Outfitma as a Creator and remain in effect until terminated.
14.2 Termination by Creator. You may stop being a Creator (delete your account) at any time. Termination does not relieve you of any obligations incurred prior to termination (e.g. taxes, outstanding disputes).
14.3 Termination by Outfitma. Outfitma may terminate your Creator access for any reason (e.g. breach of terms, policy changes, business reasons). If terminated, Sections 5–14 and any other provisions meant to survive will remain in effect.
14.4 Effect of Termination. Upon termination:
- You lose the right to access the Creator dashboard and create new offerings.
- Customers will no longer be able to subscribe or purchase your offerings after existing paid terms expire.
- Except as set forth above, Outfitma will delete your content after any retention period.
- Any amounts owed to you will be paid in accordance with Section 7 (subject to offsets for refunds, chargebacks, etc.).
15. Changes to These Terms
Outfitma may update these Creator Terms from time to time. We will notify you of changes (e.g. by email or dashboard notice) before they take effect. If you continue to operate as a Creator after changes, you accept the updated terms. If you do not agree, you must close your account.
16. Governing Law and Dispute Resolution
These Creator Terms are governed by the laws of Germany (and EU regulations), without regard to conflict of laws. Any disputes will be subject to the jurisdiction of the competent courts of Germany, unless otherwise required by law. The specific court venue will be fixed upon registration of the operating legal entity and is subject to legal review.
